FAIR DEBT COLLECTION
Provided By
Charley Brown's Office
Attorney General
Consumer Protection Division
Complaints <20>about <20>harrassment by debt collectors are <20>among
the most numerous complaints <20>received by <20>my Consumer Protection
Division. <20>There are both federal and state laws to protect <20>you
from unfair debt collection practices.
A debt collector may contact you in person, <20>in writing, <20>or
by phone. <20>However, <20>a <20><>debt collector may not <20>contact <20>you at
inconvenient <20>or <20>unusual <20>times <20>or at <20>work <20>if <20>your <20>employer
disapproves.
You <20>may <20>stop <20>a collection agency from contacting <20>you <20>by
writing <20>a <20>letter telling them to stop. <20>Once they receive <20>this
letter, they may not contact you again.
No debt collector may threaten you with criminal prosecution
to scare you into paying a bill. <20>A collection agency cannot sue
you, garnish your wages, or seize collateral on it's own.
Collection <20>agencies <20>cannot <20>use obscene language <20>or <20>make
false <20>statements <20>when collecting a debt. <20>In most cases, <20><>the

collector is <20>not <20>allowed to tell anyone other than you or <20>your
attorney that you owe money.
If <20>you <20>should encounter problems with <20>a <20>debt <20>collection
agency, <20>please contact my Consumer Protection Agency, <20>toll free
in West Virginia, at 1-800-368-8808.
